THESE CONDITIONS OF SALE (THESE "CONDITIONS OF SALE") GOVERN YOUR PURCHASE OF ANY PRODUCT OR SERVICE OFFERED BY X FUSION FURNITURE. (X FUSION) ON THE X FUSION FURNITURE WEBSITE (THE "SITE"). PLEASE READ THESE CONDITIONS OF SALE CAREFULLY. THEY CONTAIN VERY IMPORTANT INFORMATION ABOUT YOUR RIGHTS AND OBLIGATIONS AS WELL AS LIMITATIONS AND EXCLUSIONS THAT MAY APPLY TO YOU.
BY CLICKING ON THE PLACING AN ORDER, YOU ACKNOWLEDGE THAT YOU HAVE READ, ACCEPTED AND AGREED TO BE BOUND BY THESE CONDITIONS OF SALE, WITHOUT LIMITATION OR QUALIFICATIONS. THESE CONDITIONS OF SALE ARE SUBJECT TO MODIFICATION SO PLEASE READ THESE CONDITIONS OF SALE EACH TIME YOU MAKE A PURCHASE.
- Two weeks Price Guarantee. If within 15 days of purchase you find the identical item with the same service and finance terms advertised for less, X fusion will gladly refund you the difference.
- X fusion is an authorized distributor of the products offered for sale on the Site. X fusion may discontinue any product at any time without notice.
- Purchasers. You must be at least 18 years of age and a United States resident living within a 50-mile radius of X fusion store to order products from the web site.
- Orders. The placing of an order by you is only an offer by you to purchase products from X fusion . X fusion is under no obligation to accept your order or deliver you any merchandise until your order is deemed "accepted" by X fusion . Acceptance of your offer will be deemed to have occurred when X fusion store representative contacts you via the telephone number you provided during the order process to confirm your order.
- Return and Refund Policy. Excluding bedding, merchandise which is not defective and is originally packed can be exchanged within 7 days of delivery but the delivery and the pick up fee, the cost of fabric treatment and the 25% deposit on special orders will not be refunded. Your order may be cancelled up to 48 hours prior to delivery or at any time before pick up but the 25% down payment on special orders will not be refunded. Purchases paid by check will be refunded 10 working days from date of payment.
- Delivery X fusion delivers to any
shipping address that lies within a 20-mile radius of X fusion store

If the items you purchase are in stock at the time you place the order, in
most cases delivery will be made within 1 week.
After you place your order, X fusion store representative will contact you to confirm your purchase and to arrange delivery. You will be given a date range to choose from and will have the option of choosing a date most convenient for you. It is our policy to deliver your entire order at the same time.
Any changes in the actual order or the delivery address must be made by telephone or e-mail. The change requested must be made and confirmed at least 48 hours prior to the scheduled delivery date in order to prevent an additional delivery charge.
- Payment Policy. All online purchases can be made with any major credit card, including MasterCard, VISA, American Express and Discover through X fusion Pay pal account. C.O.D (cash/check on delivery) is also accepted. Personal checks are accepted up to $200.00 only with valid New York state drivers Licence.
- Limitation of Liability. TO THE MAXIMUM EXTENT ALLOWED BY LAW, X FUSION SHALL NOT BE LIABLE TO YOU FOR ANY SPECIAL, CONSEQUENTIAL, PUNITIVE, EXEMPLARY OR INCIDENTAL DAMAGES (INCLUDING LOST OR ANTICIPATED REVENUES OR PROFITS RELATING TO THE SAME), ARISING FROM ANY CLAIM RELATING TO THESE CONDITIONS OF SALE, PRODUCT(S), SERVICE(S) OR ORDER(S), WHETHER SUCH CLAIM IS BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE OR STRICT LIABILITY) OR OTHERWISE. IN NO EVENT WILL THE COLLECTIVE LIABILITY OF X FUSION TO YOU EXCEED THE AMOUNT YOU HAVE PAID TO X FUSION FOR THE APPLICABLE ORDER OR PRODUCT OUT OF WHICH LIABILITY AROSE. These limitations shall apply notwithstanding any failure of essential purpose of any remedy.
- Title to Products. X fusion Furniture retains all right, title and interest in and to the ordered products until the products have been delivered and you have paid for the products in full.
- Collection Fees. If X fusion Furniture hires an attorney or pays any monies to collect payment from you, we shall be entitled to collect from you all collection costs, including attorneys' fees.
